The Kings County Online Permits Center (the KCOPC) is owned and operated by the County of Kings (the County). The KCOPC is provided as a service to you (the User) under the following terms and conditions, including any operating rules or policies that may be promulgated by the County (“Agreement”). This Agreement is made by and between the User and the County. |
Terms of Agreement: |
1. | The User’s use of the KCOPC is subject to the County’s Disclaimer. The User agrees that the use of the KCOPC is at the User’s own risk. The KCOPC is provided on an “as is” and “as available” basis. The County makes no warranty that the KCOPC will be uninterrupted, timely or free. |
2. | The User will pay for any third party service charges or credit card fees associated with the KCOPC. |
3. | The User understands and agrees that any software downloaded through the use of the KCOPC is done at the User’s own discretion and risk. The User will be solely responsible for any damages to the User’s computer system or loss of data that results from the downloading of software. |
4. | The User will provide current, complete and accurate registration information. |
5. | Once the registration process is complete, the User will have a personalized User ID and password. The User is solely responsible for maintaining the confidentiality of User’s ID and password. |
6. | The User is responsible for maintaining the accuracy of the registration information if there is any change. If any information provided by the User is inaccurate, the County retains the right to terminate the User’s right to use the KCOPC. |
7. | User is solely responsible for any and all activities which occur in the KCOPC associated with the User ID and password. The User agrees to immediately notify the County of any unauthorized use of any User ID and password or any other security concerns of the User. |
8. | The User can terminate the User ID at any time by notifying the County. |
9. | The resale or commercial use of the KCOPC is strictly prohibited. The User will not copy, reproduce, republish, upload, download, post, transmit or duplicate any unauthorized material obtained from the KCOPC. |
10. | The User understands that information provided using the KCOPC may be subject to disclosure pursuant to the Public Records Act. |
11. | The County may change these terms and conditions at any time. In addition, the County reserves the right to change or discontinue the KCOPC at any time with or without notice to the User. |
12. | The User’s violation of any term and condition of this Agreement may cause the User to be disqualified from using the KCOPC. |
13. | The User will comply with all applicable federal, state, local laws, rules, regulations and ordinances. Each and every provision of law and clause required by law to be inserted into this Agreement shall be deemed to be inserted herein and this Agreement shall be read and enforced as though it were included therein. |
14. | This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of California. Any action brought to enforce the Agreement and/or in connection with the KCOPC shall be brought in either the state or federal courts in the County of Kings, State of California. |
15. | The User certifies that it has read and understands the terms and conditions of this Agreement. By clicking the “accept” statement below, User agrees to the terms and conditions of this Agreement. |
